O progresso em um acordo de mais de uma década está exigindo que todos os novos táxis amarelos que entram na frota de Nova York sejam acessíveis para cadeiras de rodas.
O acordo originalmente previa que 50% da frota da Taxi and Limousine Commission (TLC) de Nova York deveria ser acessível para cadeiras de rodas até 2020. Recentemente, ela foi ajustada para uma regra de 100% que exige que todos os novos táxis que entrarem na frota sejam acessíveis para cadeiras de rodas a fim de atingir efetivamente a meta de 50% após a falta de conformidade da TLC, mesmo quando o prazo para a obrigação original foi estendido para 2023.
Em junho de 2023, menos da metade da frota de Nova York era acessível para cadeiras de rodas, “atingindo apenas 32% para o requisito de medalhão autorizado e 42% para o requisito de medalhão ativo”, de acordo com os registros do tribunal.
Um novo prazo para que 50% da frota (tanto autorizada quanto Active Medallion) seja acessível para cadeiras de rodas foi estabelecido para 2028.
Os táxis devem realizar um “hack-up” (atualização da manutenção) a cada sete anos em Nova York. Devido a essa decisão de atualização, toda atualização daqui em diante deve envolver a adição de equipamentos de acessibilidade.
Até o momento, há mais de 13.000 táxis amarelos de Nova York em operação. Lembre-se de que, quando a ação original foi movida, apenas 2% da frota de táxis de Nova York era acessível para cadeiras de rodas.
Em comparação, Nova York agora tem mais de 80.000 veículos de carona compartilhada ativos (Lyft, Uber, etc.). Isso gera conflitos com os motoristas de táxi de Nova York, que argumentam que a pressão para equipar seus veículos aumenta ainda mais a pressão sobre um retorno lento da Covid-19 e a concorrência já difícil contra os serviços de carona compartilhada.
Embora o TLC tenha tentado recuar e se livrar do acordo alegando “defesa de impossibilidade” sobre sua falha no cumprimento (o que basicamente significa que eles estavam alegando que a decisão era uma tarefa impossível), o tribunal negou, concluindo que eles não tomaram “praticamente todas as medidas ao seu alcance para cumprir seus deveres nos termos do contrato”.
Portanto, os novos prazos permanecerão em vigor e a TLC deverá cumpri-los. No entanto, se um motorista de táxi puder provar dificuldades financeiras, o TLC acrescentou uma emenda para conceder a ele uma extensão extra de seis meses para adicionar rampas.

O Acordo de Classe Original e o Acordo de Classe Emendado permanecem executáveis e os Réus devem (1) tomar imediatamente todas as medidas necessárias para modificar a regra atual de 50% da TLC para implementar uma regra de 100% (de acordo com a Seção III(A)(3)) até que cumpram os Requisitos de Medalhões Autorizados e Ativos e (2) fornecer relatórios semestrais (conforme prescrito na Seção IV) ao Conselho da Classe e a este Tribunal a partir de 10 de janeiro de 2025.
